1. Agreement
These Terms govern your use of MidRally, operated by MidRally (“we”, “us”). By creating an account or using the service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the service.
2. What the service does
MidRally helps an organizer find a fair place for a community to meet from privacy-preserving, aggregate signals. Recommendations (host cities, central points, nearby venues, travel estimates) are informational and provided “as is”; you’re responsible for your own travel, venue, and safety decisions.
3. Your account
You must provide accurate sign-in information, keep your account secure, and be old enough to form a binding contract (and at least 13, or the minimum age where you live). You’re responsible for activity under your account.
4. Acceptable use
You agree not to:
- attempt to re-identify, deanonymize, or otherwise determine an individual member’s location from aggregate results;
- collect responses from people without their knowledge, or use the service to harass, surveil, or endanger anyone;
- probe, scrape, overload, or circumvent the security, privacy thresholds, or rate limits of the service;
- use the service unlawfully or infringe others’ rights.
5. Organizer responsibilities
If you run a community, you’re its controller for the participation you solicit: invite only people who expect to hear from you, be transparent about why you’re collecting responses, and honor members’ requests to withdraw. The privacy threshold (k) exists to protect members — don’t try to defeat it.
6. Plans, billing & cancellation
- Free and paid plans. Plan limits (number of communities and responses unlocked per community) are shown on the pricing page. Members are never charged.
- Billing. Paid plans are billed in advance for the interval you choose (monthly or yearly) via our payment processor, and renew automatically until canceled.
- Cancellation. You may cancel anytime from your account; you’ll revert to the free plan. Unless required by law, payments already made are non-refundable, and cancellation stops future renewals rather than refunding the current period.
- Closing your account. If you hold an active paid subscription you must cancel it before closing your account, so no further charges occur.
- Changes. We may change plans or prices prospectively; we’ll give reasonable notice and changes won’t affect an interval you’ve already paid for.
7. Privacy
Our handling of data is described in the Privacy Policy, which forms part of these Terms. In short: we store no street addresses or precise locations, only metro buckets, and organizers see only aggregate results.
8. Intellectual property
The service, its software, and its branding belong to us or our licensors. Content you provide remains yours; you grant us the limited license needed to operate the service for you. Map data is © OpenStreetMap contributors and used under its license.
9. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We don’t warrant that recommendations, travel estimates, or third-party venue information are accurate, complete, or suitable for your purposes.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or USD $50.
11. Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service or its users. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Courts located there have jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.
13. Changes
We may update these Terms; we’ll revise the “last updated” date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept them.
